Terms and Conditions – Direct Cremation

These Terms and Conditions govern the provision of direct cremation services by Mulligans Direct Cremation, a trading name of Mulligans Funeral & Monumental Services Ltd. By instructing us to provide services, you agree to these Terms and Conditions.
1. Our Services
We provide direct cremation services, where the cremation takes place privately without a service or attendees present.
Cremations are arranged at a crematorium in the North West of England. Following the cremation, ashes are returned to the family, with collection or delivery options explained at the time of arrangement.
Collection of the deceased and return of ashes are included within a 30-mile radius of our branches in Reddish (Stockport) or Gorton (Manchester). Collections or deliveries beyond this distance may incur additional charges, which will always be explained in advance.
2. Costs and Payment
2.1 Payment Terms
Full payment for direct cremation services is required before the cremation takes place. We are unable to proceed until payment has been received in full.
2.2 Additional Costs
Any additional costs or disbursements, if applicable, will be clearly explained and confirmed before being incurred.
2.3 Non-Payment
If payment is not received by the agreed date, services may be delayed until payment is confirmed. Any discounted pricing may no longer apply, and the standard charge for services provided may become payable.
2.4 Late Payments
If any amount remains outstanding more than 7 days after the due date, we reserve the right to charge interest at 8% per annum above the Bank of England base rate, in accordance with statutory provisions.
2.5 Refunds
Refunds will only be issued if services are cancelled before arrangements have commenced. Any costs or disbursements already incurred at the point of cancellation will be non-refundable.
3. Cancellation and Changes
3.1 Cancellation Rights
You have the right to cancel within 14 days in accordance with the Consumer Contracts Regulations 2013. If services have begun during this period, you may be liable for costs incurred up to the point of cancellation.
3.2 Changes
Any requested changes to arrangements should be communicated as soon as possible. We will do our best to accommodate changes, but additional charges may apply.
3.3 Cancellation After Services Commence
If cancellation occurs after arrangements have begun, you will be responsible for all costs incurred up to that point, including any third-party fees.
4. Complaints and Dispute Resolution
If you have any concerns regarding our services, please contact us directly so we can attempt to resolve the matter promptly and fairly.
5. Limitation of Liability
5.1 Standard of Care
We will provide our services with reasonable care and skill. Our liability for any loss or damage (except for death or personal injury caused by our negligence) is limited to the cost of the services provided.
5.2 Force Majeure
We are not liable for delays or failure to perform services due to circumstances beyond our reasonable control, including but not limited to adverse weather, government restrictions, strikes, or other unforeseen events

6. Data Protection
We comply with the UK General Data Protection Regulation (UK GDPR). Personal information will only be shared with third parties where necessary to provide our services (such as crematoria or medical professionals). We do not sell personal data or use it for marketing without consent.
7. Ashes and Personal Property
7.1 Ashes
Ashes will be retained for up to three months following cremation. If no arrangements are made within this period, we reserve the right to scatter or inter the ashes respectfully.
7.2 Personal Property
Any personal property left with us will be stored with reasonable care. We do not accept liability for loss or damage unless caused by our negligence.
8. Governing Law
These Terms and Conditions are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
