1. Introduction

These Terms and Conditions govern the provision of direct cremation and funeral services by Mulligans Funeral Service. By engaging our services, you agree to these terms. Mulligans Funeral Service is a proud member of the National Association of Funeral Directors (NAFD), adhering to the standards of the Funeral Director Code, ensuring transparency, high standards of care, and ethical practices.

2. Services

We offer direct cremation services in the North West of England, including chapel visits, webcasting, and a choice of music. Our cremations take place in Cheshire, and we provide the return of ashes along with options for memorial jewellery and ashes caskets.

Collection of the deceased and the delivery of cremated remains are included within a 30-mile radius of our branches in Manchester or Stockport. Collections or deliveries beyond this distance may incur additional charges.

3. NAFD Membership

As members of the NAFD, we adhere to The Funeral Director Code. This ensures the highest standards in areas like pricing transparency, diversity, and the dignified care of the deceased. Our services are subject to regular inspections by the NAFD to ensure compliance with these standards.

4. Costs and Payment

4.1 Payment Terms: Payment for all direct cremation services is due prior to the cremation taking place. We cannot proceed with the cremation until full payment has been received. In cases where additional services such as chapel visits or memorial items are added, the relevant charges will be included in your estimate.

4.2 Additional Costs: Third-party fees (such as cremation fees, medical certificates, and other disbursements) will be clearly outlined in your estimate. These costs are outside of our control but will be communicated upfront.

4.3 Non-Payment:

  • If payment is not made in full prior to the cremation, services may be delayed until payment is received. No cremation will take place until payment is confirmed.

  • Loss of Discounts: In the event of non-payment by the agreed date, any discounts applied will be forfeited, and the full standard amount for services rendered will become immediately due.

4.4 Late Payment Penalties: If any payment remains outstanding for more than 7 days after the due date, we reserve the right to charge interest on the overdue amount at a rate of 8% per annum above the Bank of England base rate until payment is made in full.

4.5 Refunds: Refunds will only be issued if a service has been cancelled prior to the commencement of any arrangement. Any disbursements or third-party costs already incurred at the time of cancellation will be non-refundable.

5. Cancellation and Changes

5.1 Cancellation: You have the right to cancel our services within 14 days under the Consumer Contracts Regulations 2013. However, if the cremation or other services have begun within this period, you may be liable for any costs incurred up until the point of cancellation.

5.2 Changes: Any changes to the funeral arrangements must be communicated in writing at least 2 business days in advance. We will do our best to accommodate changes, but additional charges may apply based on the adjustments required.

5.3 Cancellation After Services Commence: If you cancel the service after it has commenced but within the cooling-off period, you will be responsible for all costs incurred up to the date of cancellation, including third-party fees and any reasonable administrative costs.

6. Complaints and Dispute Resolution

If you have concerns about any aspect of our service, please contact us directly so we can resolve the issue. As NAFD members, we follow the NAFD’s complaints procedure, which includes providing clients with access to NAFD Resolve, an alternative dispute resolution body, if the issue cannot be resolved locally.

7. Limitation of Liability

7.1 We will provide our services with reasonable care and skill. However, our liability for any loss or damage suffered by you as a result of our services (except for death or personal injury caused by our negligence) will be limited to the cost of the services we provide.

7.2 We are not liable for delays or failures caused by factors beyond our reasonable control, including but not limited to natural disasters, adverse weather conditions, strikes, government restrictions, or other unforeseen events (force majeure).

7.3 Force Majeure: In the event of any delays or inability to perform our services due to force majeure (such as natural disasters, war, or pandemics), we will notify you as soon as possible. In such cases, we reserve the right to extend the time for performing services or to cancel the agreement without liability.

8. Data Protection

We respect your privacy and comply with the UK General Data Protection Regulation (GDPR). Your personal information will only be shared with third parties necessary for the provision of our services (such as crematoria or medical professionals). We will not disclose your personal information to third parties for marketing purposes without your consent.

9. Property and Ashes

9.1 Ashes Collection: We will retain ashes for up to 3 months following cremation. After this period, if you have not made arrangements for collection or delivery, we reserve the right to scatter or inter the ashes at an appropriate location.

9.2 Personal Property: Any personal property left with us in relation to the deceased will be kept safe for a reasonable time. However, we do not accept liability for any loss or damage to such items unless caused by our negligence.

 

10. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts in England and Wales.
